These Terms & Conditions (“Terms”) govern your use of the Uttaradhikari website and mobile application (“Platform”). By accessing or using the Platform, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to use the Platform.

By registering, you confirm that you meet this requirement.

2. Nature of Services

Uttaradhikari is a digital information storage and access management platform that enables users to organize personal, financial, insurance, and nominee-related information.

• Does NOT provide legal advice
• Does NOT provide financial or investment advice
• Does NOT act as executor, trustee, or legal representative
• Does NOT guarantee inheritance or claim outcomes

3. User Responsibilities

Users are solely responsible for:

• Accuracy of uploaded data
• Legality of documents
• Safeguarding login credentials
• Granting access to nominees or third parties
• Ensuring compliance with applicable laws

Uttaradhikari does not verify the authenticity or legal validity of uploaded documents.

4. Nominee & Successor Access

Users may designate nominees or successors. However:

• Uttaradhikari does not validate legal entitlement
• Access is provided based on user configuration
• Disputes must be resolved independently
• Uttaradhikari is not liable for misuse by authorized nominees

5. Payments

Payments are processed via HDFC Bank authorized gateways.

• We do not store payment credentials
• Refund policies (if applicable) are governed separately
• Payment disputes must follow gateway policies

6. Prohibited Use

You shall not:

• Upload unlawful or fraudulent content
• Attempt unauthorized system access
• Reverse engineer the platform
• Use the platform for illegal purposes

7. Intellectual Property

All platform content, trademarks, software, and branding belong exclusively to Uttaradhikari. Unauthorized reproduction is prohibited.

8. Suspension & Termination

We reserve the right to:

• Suspend accounts
• Remove content
• Restrict access

Without prior notice if Terms are violated.

9. Limitation of Liability

No Indirect Damages

Uttaradhikari shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages including but not limited to:

• Loss of profits
• Loss of data
• Business interruption
• Reputation loss

Aggregate Liability Cap

Total aggregate liability of Uttaradhikari for any claim arising out of or relating to the Platform shall not exceed:

• The total subscription fees paid by the user in the preceding 12 months, or
• ₹10,000 (whichever is lower)

No Guarantee of Outcomes

• Legal enforceability of documents
• Succession outcomes
• Asset claim success
• Nominee entitlement

User-Controlled Data Risk

The user assumes full responsibility for:

• Accuracy of uploaded data
• Access permissions granted
• Legal consequences arising from stored information

Force Majeure & External Systems

Uttaradhikari shall not be liable for failures caused by:

• Government actions
• Internet failures
• Cloud outages
• Payment gateway failures
• Cyberattacks beyond reasonable safeguards

10. Indemnity

You agree to indemnify and hold harmless Uttaradhikari, its directors, employees, and partners from any claims, losses, liabilities, or legal proceedings arising from:

• Incorrect or unlawful content uploaded by you
• Breach of these Terms
• Misuse of the Platform

11. Data Protection

Use of the Platform is also governed by our Privacy Policy.

12. Force Majeure

We shall not be liable for delays or failures caused by events beyond reasonable control.

13. Arbitration & Governing Law

Any disputes shall be resolved through binding arbitration under the Arbitration and Conciliation Act, 1996.
